By downloading or using the App, these terms will automatically apply to you. Therefore, you should make sure you read them carefully before using the App. You may not copy or modify the App, any part of the App or our trademarks in any way. You may not attempt to extract the source code of the App, nor should you attempt to translate the App into other languages or make derivative versions. The App itself and all trademarks, copyright, database rights and other intellectual property rights related to it remain ours.

1. Changes to this Agreement

TECHNO AIR INC may change these Terms of Use from time to time. All changes to this Agreement will be made available on this website, which is why we encourage users to check this page frequently to be aware of any changes to these Terms of Use. Changes to this Agreement will not prejudice the rights of users without their consent. These terms and conditions are effective from the last update.

2. License

You hereby grant us an irrevocable, perpetual, transferable, fully paid, royalty-free, worldwide license (including the right to sublicense and transfer to third parties) and the right to copy, reproduce, repair, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, sublicense, transfer, lease, transmit, publicly display, publicly perform or provide access to broadcast electronically. Except where prohibited by law, you waive any right of attribution or any moral rights in your User Content, whether or not your User Content is altered or modified in any way. We do not claim any ownership rights in your User Content and nothing in these Terms of Service is intended to restrict any rights you may have to use and exploit your User Content. We have no obligation to monitor or enforce your intellectual property rights in your User Content.

3. Links to Games

You may link to our Games, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part.

Where the Games contain links to other websites and resources provided by third parties, these links are provided for your convenience only. We have no control over the contents of those sites or resources, and assume no responsibility for them or for any loss or damage that may arise from your use of them.

4. Limitation of Liability

In no event will TECHNO AIR INC (or its suppliers) be liable to you or any third party for any lost profits or any indirect, consequential, exemplary, incidental, special or punitive damages arising out of or in connection with this Agreement or TECHNO AIR INC's privacy practices, any Application, even if TECHNO AIR INC has been advised of the possibility of such damages. Access to and use of any Application is at your own discretion and risk, and you will be solely responsible for any damage to your computer system or mobile device, or loss of data resulting therefrom. In no event will TECHNO AIR INC's suppliers have any liability arising out of or in any way related to this Agreement.

5. Modifications

TECHNO AIR INC reserves the right to modify, suspend or discontinue the Application or any part thereof at any time without notice. You agree that we shall not be liable to you or any third party for any modification, suspension or discontinuance of any Application or any part thereof.

6. Disclaimer

The Application is provided on an "as is" and as available basis, and we (and its suppliers) expressly disclaim all warranties and conditions of any kind, whether express or implied, including warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. We (and its suppliers) make no warranty that any Application: (A) will meet your requirements; (B) will be available on an uninterrupted, timely, secure, or error-free basis; or (C) will be accurate, reliable, complete, legal, or safe.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

7. User Content

A user's "User Content" means any and all Content that such user uploads, distributes, or otherwise makes available through any Application. You are solely responsible for your User Content. You assume all risks associated with the use of your User Content, including any reliance on its accuracy, completeness, or usefulness by others, or any disclosure of your User Content that personally identifies you or any third party. You hereby represent and warrant that your User Content does not violate the Acceptable Use Policy. You may not state or imply that your User Content is in any way provided, sponsored or endorsed by TECHNO AIR INC. TECHNO AIR INC has no obligation to back up any User Content, and User Content may be deleted at any time.

8. License

By uploading, distributing or otherwise using your User Content on any Application, you automatically grant, and you represent and warrant that you have the right to grant, to us an irrevocable, non-exclusive, royalty-free and fully paid, worldwide license, with the right to grant sublicenses, to reproduce, distribute, publicly display, publicly perform, prepare derivative works of, incorporate into other works, and otherwise use your User Content solely for the purpose of displaying your User Content on any Application.

9. Severability

If any provision of this Agreement is held to be invalid or unenforceable for any reason, the other provisions of this Agreement will be unimpaired and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.
